On September 26, 2024, U.S. Senator Rand Paul (R-KY), introduced the HEMP Act (S. 5135)— a reintroduction of the same legislation proposed in 2021 — to relieve unnecessary constraints on the Hemp Industry.
“For years, I’ve led the fight in Washington to restore one of Kentucky’s most historically vital crops by legalizing industrial hemp. We achieved a hard-won victory, but there is still work to do to prevent the federal government from weighing down our farmers with unnecessary bureaucratic micromanaging. My legislation will help this growing industry reach its full economic potential and bring transparency to government regulations,” ~Dr. Paul.
The HEMP Act would amend the definition of hemp from 0.3% delta-9 THC to 1% delta-9 THC, among other changes to testing requirements and shipping regulations:
amends the definition of “hemp” from 0.3 % delta-9 THC to 1 % delta-9 THC
requires testing of hemp-derived products rather than the hemp flower or plant itself
With a Measure of uncertainty at not more than 0.075%
requires that hemp shipments be accompanied by
(1) copy of a valid license or authorization issued to a producer, OR
(2) Copy of a COA demonstrating hemp contains not more than 1% delta-9 THC on a dry weight basis
