Oregon critics say new U.S. law will ‘wipe out 95% to 99%’ of hemp industry, take CBD gummies and oils off shelves

A new federal law tucked into the government funding bill is drawing sharp criticism from Oregon and national hemp stakeholders. The law bans hemp products containing more than 0.4 mg of total THC per package, a limit critics say will eliminate 95% to 99% of the hemp industry—including CBD gummies, oils, and beverages.

Supporters, including Sen. Mitch McConnell, argue the rule is needed to curb intoxicating hemp products marketed to children. Opponents, including Oregon Sen. Jeff Merkley and Kentucky Sen. Rand Paul, economists, and industry experts—warn the limit is so restrictive it will wipe out nearly all hemp-derived products, create major uncertainty for farmers, and undermine a $28 billion national industry.

Industry leaders, including Ag Hemp Solutions' Chief Legislative Strategist Courtney N. Moran, LL.M. note that while industry stakeholders support removing unsafe products or products marketed to children, the new law goes far beyond that intent and threatens the viability of the hemp industry as a whole unless amended before it takes effect in November 2026.

Moran said she’s optimistic. “I don’t think this is game over,” she said. “It’s a wake-up call.”
