Representatives Respond to House Attempts to Reschedule Marijuana and Redefine Hemp in Appropriations Bills

Protecting the Hemp Industry


Representatives Nancy Mace (R-SC) and Morgan McGarvey (D-KY) have proposed amendments with support from Representatives Thomas Massie (R-KY), James Comer (R-KY), and Andy Barr (R-KY) to remove Section 760 from the House's Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act of 2025 (H.R. 9027). Section 760 mirrors the language of the "Miller Amendment" in the House 2024 Farm Bill, which would effectively ban the sale of consumable hemp products like Delta-8 with any quantifiable amount of THC or “any other cannabinoids that have similar effects.” The bipartisan proposed amendment seeks to remove proposed restrictions on consumable hemp products, showing strong Congressional support for protecting the cannabinoid hemp industry’s future.

Protecting the DEA's Ability to Reschedule Marijuana


Representative Rashida Tlaib (D-MI) additionally proposed an amendment to the Commerce, Justice, Science, and Related Agencies Appropriations Act of 2025 (H.R. 9026) to remove section 623, which prevents funds from being used to reschedule marijuana or remove marijuana from established schedules. This section was included in the initial appropriations bill as an attempt to block the Biden administration's attempts to reschedule marijuana from Schedule I to Schedule III, though the DEA would still have time to act before the 2025 budget is implemented.
