USDA Lists Hemp Analytical Testing Laboratories Registered with DEA

In accordance with the USDA Interim Final Rules (IFR), any laboratory testing hemp for THC concentration under the US Domestic Hemp Production Program must be registered with the Drug Enforcement Administration (DEA).

The USDA Agricultural Marketing Service website now provides a directory of laboratories that are registered with the DEA. The directory is searchable by state. Please note, hemp producers are responsible for verifying with their state or Tribe where their hemp may be tested, therefore the directory is for informational purposes only. Until October 31, 2020 or Plan approval, whichever comes first, States operating under the 2014 Farm Bill are not subject to the same regulations as those operating under the 2018 Farm Bill.

Despite the Enforcement Discretion Guidance issued in February delaying enforcement of the DEA lab regisration requirment, the recent posting from USDA listing hemp testing laboratories who are registered with the DEA is a clear indication there is no intent to remove the DEA lab registration requirement from the final program rules. 

Like this unnecessarily burdesome DEA lab reigstration requirement, full implementation of the USDA Interim Final Rules regulating hemp production threaten the survival and success of nascent and established businesses, as well as farmers.
