2026 House Farm Bill Proposes Significant Industrial Hemp Policy Reforms

The House Ag Committee introduced H.R. 7567, the Farm, Food, and National Security Act of 22026 House Farm Bill Industrial Hemp Policy026 (2026 House Farm Bill), which includes proposed amendments to the federal hemp program that could positively impact hemp producers across the United States.
The 2026 House Farm Bill passed the U.S. House of Representatives on April 30, 2026, by a vote of 224-200, and was received in the Senate on May 19, 2026, where it awaits further consideration.
One of the most significant changes would require hemp producers to designate their crops as either:
Industrial hemp only, or
Hemp grown for any purpose other than industrial hemp.
The House Farm Bill would also allow states, Tribal governments, and the U.S. Department of Agriculture (USDA) to reduce or modify sampling and testing requirements for industrial hemp producers through the use of visual inspections, certified seed programs, and other alternative compliance measures. Producers seeking these benefits would need to provide documentation demonstrating a clear intent to cultivate industrial hemp.
Additionally, the legislation would codify the use of total THC testing, including THCA, while maintaining the federal hemp threshold of 0.3% total THC on a dry-weight basis.
Other proposed changes include:
New reporting and recordkeeping requirements;
Modified enforcement provisions for producers who violate hemp production designations;
Potential relief from certain felony-related participation restrictions for industrial hemp producers; and
Creation of a USDA laboratory accreditation program for hemp testing facilities.
Notably, the 2026 House Farm Bill new regulatory framework proposed for industrial hemp growers substantially mirrors the Industrial Hemp Act of 2023, legislation co-authored by our Chief Legislative Strategist, Courtney N. Moran, LL.M., and incorporates many of the Act's key provisions and core regulatory principles. If enacted, these amendments would further distinguish industrial hemp production from cannabinoid-focused hemp cultivation and would positively influence future hemp regulation and compliance requirements.
